Conditions of Participation

1. ORGANIZER

The organizer of the competition is Polly GmbH, Brussels Str. 39 - 41, 50674 Cologne. The competition is not connected to Facebook, Instagram and is in no way sponsored, supported or organized by Facebook or Instagram. In addition to our newsletter, Facebook and Instagram are only platforms on which Polly GmbH markets the competition. The recipient of the information provided is not Facebook or Instagram, but Polly GmbH. All questions, comments and/or complaints about the competition should be directed exclusively to Polly GmbH.

2. ELIGIBILITY

Only people who are resident in Germany and have reached the age of 18 are eligible to participate. Employees of Polly GmbH or companies affiliated with it are excluded from participation.

3. DEADLINE FOR PARTICIPATION

Information about the participation deadline can be found in the competition on the respective platform or further down in the section of the individual competition.

4. PARTICIPATION

Participation in the competition takes place by participating on the respective social media channel. The participation requirements, the duration of participation, the prizes and information on how to win can be found in the competition description (see below).

Polly GmbH reserves the right to cancel or end the competition at any time. This applies in particular in the event of force majeure or if the competition cannot be carried out or continued for other (organizational, technical or legal) reasons. In such a case, participants are not entitled to any claims.

By participating in the promotion, the participant accepts these terms and conditions.

Purchasing products from Polly GmbH or the external partners mentioned under 6. of these conditions of participation does not increase the chance of winning.

5. WINNER SELECTION AND NOTIFICATION

The winners will be drawn at random and will be informed via Instagram direct message within 7 days of the competition . Winners must also respond to the direct message within 7 days . If a winner does not respond within the specified deadline, their prize will be raffled off again among all participants.

6. PROFITS

The prize depends on the respective competition. All information can be found in the competition on the platform itself or later in the section of the individual competition. A cash payment is not possible.

7. SHIPPING OF THE PRIZE

In order to claim the prize, the winner undertakes to provide Polly GmbH with his name and address within the aforementioned period of 7 days. Shipping takes place via us or our partners. There may be delays due to public holidays. The participant is responsible for the accuracy of the data.

8. PRIVACY

In order to transmit the prizes, the personal data (email address, name and address) of the winners will be passed on to third parties. The delivery of the respective prizes cannot be provided with a guaranteed delivery date. This may vary depending on the competition partner.

9. LEGAL ACTION

Legal recourse is excluded.

10. LIABILITY

Polly GmbH is not liable for damages related to participation in the competition or the acceptance and use of the prize, unless the competition provider or its vicarious agents act intentionally or with gross negligence. This does not affect any claims for compensation due to injury to life, body and health as well as essential contractual obligations.

11. SEVERABILITY

Should one or more of the above clauses be or become wholly or partially void, ineffective or unenforceable, the remaining conditions remain in effect. A corresponding valid clause takes its place. The same applies if there is a loophole in the regulations.
