Conditions of Participation

1. ORGANIZER

The organizer of the competition is Polly GmbH, Alpenerstraße 16, 50825 Cologne, Germany. The competition is not affiliated with Facebook, Instagram and is in no way sponsored, endorsed or organized by Facebook or Instagram. Facebook and Instagram, in addition to our newsletter, are merely platforms on which Polly GmbH promotes the competition. The recipient of the information provided is not Facebook or Instagram, but Polly GmbH. All questions, comments and/or complaints regarding the competition are to be directed exclusively to Polly GmbH.

2. ELIGIBILITY

Only persons residing in Germany and who have reached the age of 18 are eligible to participate. Employees of Polly GmbH or companies affiliated with it are excluded from participation.

3. ENTRY DEADLINE

Information on the entry deadline can be found in the competition on the respective platform or further below in the section of the individual competition.

4. PARTICIPATION

Participation in the competition takes place by participating on the respective social media channel. The participation requirements, the duration of participation, the prizes and information on how prizes are awarded can be found in the competition description (see below).

Polly GmbH reserves the right to cancel or terminate the competition at any time. This applies in particular in cases of force majeure or if the competition cannot be carried out or continued for other (organizational, technical or legal) reasons. In such a case, participants are not entitled to any claims.

By participating in the promotion, the participant accepts these terms and conditions.

The purchase of products from Polly GmbH or external partners mentioned under 6. of these terms and conditions does not increase the chances of winning.

5. SELECTION AND NOTIFICATION OF THE WINNER

Winners will be drawn at random and informed via Instagram Direct Message within 7 days after the competition. Winners must also respond to the direct message within 7 days. If a winner does not respond within the specified period, their prize will be redrawn among all participants.

6. PRIZES

The prize depends on the respective competition. All information can be found in the competition on the platform itself or further below in the section of the individual competition. Cash payment is not possible.

7. SHIPPING OF THE PRIZE

To claim the prize, the winner undertakes to provide Polly GmbH with their name and address within the aforementioned 7-day period. Shipping is carried out by us or our partners. Delays may occur due to holidays. The participant is responsible for the accuracy of the data.

8. DATA PROTECTION

For the delivery of prizes, the personal data (e-mail address, name and address) of the winners will be passed on to third parties. The delivery of the respective prizes cannot be provided with a guaranteed delivery date. This may vary depending on the competition partner.

9. LEGAL REMEDY

The legal process is excluded.

10. LIABILITY

Polly GmbH is not liable for damages arising in connection with participation in the competition or with the acceptance and use of the prize, unless the competition provider or its vicarious agents act with intent or gross negligence. Any claims for damages due to injury to life, body and health as well as essential contractual obligations remain unaffected.

11. SEVERABILITY CLAUSE

Should one or more of the above clauses be or become wholly or partially void, ineffective or unenforceable, the remaining conditions shall remain valid. An appropriate valid clause shall take its place. The same applies in the event of a regulatory gap.
